5 Biggest Mistakes Families Make During Probate

Family discussing probate real estate decisions

After 25+ years of guiding families through probate real estate situations, I've seen the same patterns emerge again and again. The good news? Most of these mistakes are entirely preventable with a little awareness and the right support.

Mistake #1: Missing Court Deadlines

California's probate process has strict timelines. From filing the initial petition to providing notice to creditors, every step has a deadline. The most common one I see missed is the creditor claim period — families sometimes don't realize they need to formally notify creditors, and missing this step can open the estate to liability.

In Los Angeles County specifically, the court system is so backlogged that rescheduling a missed hearing can add months to the timeline. Mark every deadline. Set reminders. Work with a probate attorney who specializes in LA County cases.

Mistake #2: Making Emotional Decisions About Property

I understand — when a parent passes and you're standing in their home for the first time without them, every object carries weight. But making decisions about the property from that emotional place often leads to outcomes that don't serve anyone well.

The house itself becomes a symbol. Families fight about whether to keep it, sell it, rent it — not because of the financial reality, but because of what it represents. Here's what I tell my clients: take the time you need to grieve, but make property decisions from a place of clarity, not from a place of pain.

Mistake #3: Not Getting a Proper Property Appraisal

This is one of the costliest errors. Executors sometimes skip a professional appraisal or rely on Zillow estimates — and then either overprice the property (leading to months on market) or underprice it (leaving significant money on the table for heirs).

For probate properties in Los Angeles, accurate valuation is especially critical. The market varies dramatically from neighborhood to neighborhood. A property in Beverly Hills is a completely different valuation conversation than one in the Valley. Get a proper appraisal from someone who understands the local market.

Mistake #4: Trying to Handle Everything Alone

I've seen executors who think they can manage the legal, financial, and emotional aspects of probate entirely on their own. It almost never works well. The probate process involves court filings, property management, tax obligations, creditor negotiations, and family dynamics — it's a full-time responsibility.

You don't have to do it alone. The right team — a probate attorney, a real estate specialist, a financial advisor — can save you time, money, and enormous stress. It's not a sign of weakness to ask for help. It's the smartest decision you can make.

Mistake #5: Waiting Too Long to Address the Real Estate

Property is often the most valuable asset in an estate, but it's also the most expensive to maintain. Mortgage payments, property taxes, insurance, HOA fees, utilities — these don't stop just because someone has passed away. The longer a probate property sits unaddressed, the more the estate bleeds money.

I'm not saying rush to sell. But I am saying: get a clear picture of the property's condition, carrying costs, and market position as early as possible. An informed plan — whether that's holding, renting, or selling — is always better than paralysis.

The Bottom Line

Probate is navigable. These mistakes are preventable. With the right guidance and a clear plan, families can move through this process with dignity, financial soundness, and peace of mind. "Everything is in Divine Order" — but that doesn't mean you have to figure it all out by yourself.
